Position Summary The Director of the Disadvantaged Business Enterprise Supportive Services (DBESS) Program is responsible for the coordination and implementation of the DBESS Program through direct implementation and supervision of staff. The DBESS Program consistently operated as an adjunct to the Disadvantaged Business Enterprise (DBE) program; statutory authorization exists for the Federal Highway Administration's (FHWA) implementation of the program. The primary purpose of the DBESS Program is to provide training, assistance, and services to minority, disadvantaged, and women business enterprises certified as DBEs by the Massachusetts Unified Certification (MassUCP) Program, so as to increase their activity in the program, and to facilitate the firms' development into viable, self-sufficient organizations capable of competing for, and performing on federally assisted highway projects. Since 1982, Congress has authorized up to $10 million, annually, to accomplish these objectives. FHWA annually apportions the DBE/SS funds to STAs for the purpose of carrying out a DBE/SS program. The FHWA approves the funding of STA programs only if they demonstrate the ability to directly assist certified DBEs’ development through identifiable, metric-based results. Duties and Responsibilities * Develop an annual performance-based Statement of Work that includes clearly measurable goals and objectives consistent with the FHWA performance-based DBE/SS model program, designed to assist the FHWA, MassDOT and other interested parties in developing, conducting, and administering a cost-effective DBE/SS program. * Establish procedures, subject to the availability of Surface Transportation Program and Highway Bridge Program funds under 23 U.S.C. §140(b) (Nondiscrimination), for the provision of supportive services with respect to training programs approved under 23 CFR 230, Subpart A (Equal Employment Opportunity on Federal and Federal-Aid Construction Contracts – including Supportive Services). * Conduct an annual assessment of the availability of disadvantaged business enterprises on MassDOT’s FTA-assisted grants and establish an overall annual goal for Disadvantaged Business Enterprise (“DBE”) participation a pursuant to 49 CFR Part 26 for submission on August 1st each year. * Evaluate and implement programs to promote DBE program participation by outside contractors; attend pre-bid conferences; manage labor and contract compliance; certification and recertification procedures; and ensure compliance with federal and MassDOT DBE policies. * Implement policies and procedures to ensure efficient operation of assigned civil rights programs. * Coordinate and monitor mandated DBE/SS program compliance; complete applicable reports to government agencies; ensure program compliance in the delivery of MassDOT services. * Attend meetings, workshops and presentations with minority and women-owned businesses, the public and other stakeholders on MassDOT programs and policies. * Review and approve consultant affirmative Action plans and affirmative market commitments before award of contracts. * Interact with state and federal agencies and others such as Federal Highway Administration, Federal Transit Administration, Federal Aviation Administration, Affirmative Market Program, Executive Office of Administration and Finance Office of Access and Opportunity, Supplier Diversity Office, and the Massachusetts Office of Disability to ensure adherence to compliance, monitoring, reporting requirements. * Manage and participate in the development and implementation of goals, objectives, policies and priorities for assigned programs; recommend and administer policies and procedures. * Maintains knowledge of regulatory policy and legal material relevant to external civil rights. * Reviews and advises external civil rights staff on policies related to economic and business development efforts and education for disadvantaged business enterprise firms, small businesses, contractors and the department's workforce. * Reviews records, data and correspondence pertaining to external civil rights matters, including communication within the department and with the Federal Highway Administration, Federal Transit Administration, news media, industry, legislative representatives, contractors and community-based organizations. Federal Authorities * 23 USC 140 (c) * * *23 CFR 230 Subpart B * * 49 CFR Part 26, Appendix C* * https://highways.dot.gov/civil-rights/programs/disadvantaged-business-enterprise-supportive-services-dbess-program Preferred Qualifications * Familiarity with USDOT Civil Rights Programs and reporting. * Experience with compliance or monitoring of DBE or Small Business programs for Federal (DBE) & State (MWBE). * Ability to analyze and determine the applicability of data. * Ability to understand, apply and explain the laws, rules, regulations, procedures, specifications, and guidelines governing assigned unit activities. * Familiarity with Principles of Affirmative Action. * Proficient in Microsoft Office Suite and ability to learn software. * Strong writing and communication skills. * Proficiency in software programs necessary to support the DBE/SS programs. * Demonstrated ability to adapt to quick-pace and high-volume of work. * Exceptional customer-service focused networking and communication skills * Ability to work effectively with linguistically and culturally diverse communities. * Familiarity with D/M/WBE/Small Business development and strategic planning. * Experience in establishing D/M/WBE goals on State and Federal contracts.
